Statute of Limitations for Childhood Sexual Assault Civil Claims
California Assembly Bill 218 suspended the statute of limitation for three calendar years (January 1, 2020 through December 31, 2022) and allows a survivor of childhood sexual assault, regardless of their age, to file a civil complaint against the perpetrator of the childhood sexual assault and the perpetrator’s employer.
After December 31, 2022, survivors of childhood sexual assault must file their civil complaint before their 40th birthday or within five years of the date the survivor discovers or reasonably should have discovered that psychology injury or illness was caused by the childhood sexual assault.
